TERMS & CONDITIONS

The term “My Media Memories”, “M3”, “we” and/or “us” will hereby refer to the owners of this website — www.my-mediamemories.co.uk.

M3 own and operate this website, providing bulk photo/slide scanning services and video digitisation.

The term “you” refers to the user of this website and by accessing www.my-mediamemories.co.uk you agree to abide by the terms documented in this policy.

The term “media” will hereby refer to photographs and all past and present industry recognised formats of photographic slides and film/video tape.

You should ensure you have read the entirety of this document before proceeding to use the site and if you do not agree with or understand any of the terms mentioned here in accordance with this document you should immediately cease your use of this site.

These terms form a legal contract between you and M3 and will govern your access to and use of this site.

M3 withholds the right to change, alter or amend these terms and conditions without notice or approval. Any such change will be presented here along with details of those subsequent changes. Therefore, you should always review these terms for any changes.

Payment:

We accept payment by direct bank transfer or via PayPal. The payment terms will form part of the order confirmation and these will be communicated via email. Any cancellation requests must be made by via the Get In Touch section of the website www.my-mediamemories.co.uk or via email to: enquiries@my-mediamemories.co.uk.

Any cancellations requested following completion of the requested service will be at the discretion of M3. Any costs incurred related to completion of the requested service may be deducted from the refund where appropriate.

We reserve the right to cancel your order at any given time and refund your payment in full. All payment transactions are handled by PayPal, one of the leading payment providers in the UK. We will never ask you for your debit/credit card details.

Intellectual property:

All M3 materials, website content, logos, artwork and images that feature on but not exclusively to the website, purchased media, literature, electronic communications and social media platforms are the sole property of M3. Any reproduction, use, distribution or publication of any of these restricted materials is strictly prohibited without the express written consent of M3. Any suggestions, content, ideas, feedback or any other information directed to us via any mechanism including online, via email, telephone or writing remains the express, sole and exclusive property of M3 and you surrender any contest to ongoing ownership.

Shipping of goods and materials:

M3 cannot be held liable for any loss or damage to any goods or items in transit between the customer and our premises. Whilst every care will be taken to guard against this we hold no responsibility for the occurrence of these circumstances. We work closely with Royal Mail to provide the best in class courier service for our customers. No monetary value can be placed on media for insurance purposes and thus no claims for compensation resulting from loss, damage or theft will be considered. M3 will cooperate to its full potential to assist in any such circumstances should this situation arise.

Complaints:

In the unlikely event of a customer complaint all communications should be made via the Get In Touch section of the website www.my-mediamemories.co.uk or via email to:  enquiries@my-mediamemories.co.uk.

In any such situations M3 will first seek to correct the problem. Any consideration to be made by M3 in the form of a refund or costs incurred shall be strictly bound by the maximum value associated with the costs incurred by the customer, with no recourse for any additional level of compensation. Discounts, promotional codes and special offers.

Any price reductions, promotional codes or special offers related to the services offered by M3 on its website or elsewhere remain at the discretion of M3 and can be altered, amended and removed at any time without prior notice or consent. Media content:

By agreeing to these terms and conditions, you recognise and agree to full ownership and responsibility for the content of your media. The physical documents that make up your media remain your property at all times; as do the copyright and ownership of the images/content themselves. To this end, you are solely responsible for ensuring that these images/content do not infringe any civil or criminal law. This agreement relieves M3 of any copyright infringement and your agreement to the statements held in this document acknowledge to indemnify M3 against any legal costs incurred or damages assigned.

It is your sole responsibility to ensure you risk no copyright infringement. It is also your agreement to ensure not to include any images/content of restricted or prohibited nature. This includes content related to and including: hate speech, threatening or pornographic nature, violence, nudity or graphic or gratuitous violence. Anything deemed to relate to these types of image/content will be reported to the appropriate authorities, including the police. We reserve the right to terminate your contract with us at the earliest opportunity should any of these breaches arise.

Cancellations:

Should you wish to cancel a confirmed order, please contact us within 24 hours via the Get In Touch section of the website www.my-mediamemories.co.uk or via email to: enquiries@my-mediamemories.co.uk. Depending on the stage of the order process we have reached, you may be liable for part, or in some circumstances full, payment for any costs incurred. M3 will always look to work closely with you during these situations but asks that you appreciate that time and costs may have been incurred and will, at times, need to be recovered.

Cost of scanning service:

M3 operates on a stripped back scanning service offering allowing you, the customer, to compile a set of photographs to be processed for scanning. This service is designed for photograph sets to be submitted in a box equal to or similar in size to an average shoebox. Typically, this will number anywhere between 100 and 1,000 photographs. Should the number submitted surpass the confirmed order amount by a ratio of 15% and/ to or a level which M3 deem unacceptable, a further payment or part exclusion of excessive photo documents will be enforced. We will inform you of this in writing and work with you to pursue an amicable resolution for both parties.
